Oaths and Affidavits (Commissioners)

A Commissioner of Oaths—also referred to as a Commissioner for Taking Affidavits—can administer oaths and witness signatures on certain legal documents. 

Important Note: The Town does not have a Notary Public. Notaries have broader legal authority, including certifying true copies and notarizing documents that require their signature. If your document requires a Notary Public, you must contact a lawyer or licensed Notary. The Town of Kearney does not offer electronic or virtual commissioning.

Requirements for Commissioning

  • The individual signing the affidavit must appear in person before the Commissioner.
  • Government-issued photo ID showing both name and signature is required.
  • The document must be signed in the Commissioner’s presence.
  • Commissioning is not guaranteed until the document is reviewed.
  • Signing is at the sole discretion of the Commissioner.
  • Commissioners cannot witness documents that require personal knowledge of the signer over time (e.g., Passport Guarantor forms).

  • Domestic/Foreign Pension forms (Proof of Life)
  • Canadian Citizenship applications
  • Delayed Statement of Live Birth
  • Adult Name Change forms
  • Vehicle ownership transfer to family
  • Child Travel Consent forms
  • Visitor VISA invitation letters
  • Immunization exemption forms
  • Statutory Declaration of Lost ID
  • OSAP-related declarations (e.g., Common Law Status)
  • Amendments to Birth/Death/Marriage Certificates
  • Affidavit of Proof of Loss (vehicle/boat)
  • Affidavit of Residency
  • TICO Affidavit of Customer Claimant

Documents Not Eligible for Commissioning

  • Wills, Living Wills, Codicils, Estate documents
  • Power of Attorney
  • Divorce, separation, marriage, or cohabitation documents
  • Custody agreements
  • Debt-related documents
  • Real estate transactions
  • Court, legal, or civil documents
  • Claimant and Indemnity declarations
  • Progress Payment Distribution declarations
  • Statement of Arrears
  • Certified True Copies
  • Translator declarations
  • Age of Majority/BYID applications
  • Any document requiring a Notary Public (Canadian or Foreign)
